Mason Temple Church of God in Christ Travel Waiver Agreement
This Agreement is entered into by Mason Temple Church of God in Christ (βChurchβ) and the individual signing below (βIndividualβ), regarding transportation to and from various Church functions in vehicles furnished by or through the Church.
1. Waiver of Liability
Individual, on behalf of themselves, their parents or survivors, next of kin, personal representatives, and anyone claiming through them, waives and releases all claims for injury, loss, or damage (including death) related to the trip/event against the Church, its officers, trustees, representatives, agents, employees, and insurers β whether caused by negligence or otherwise.
2. Indemnification
Individual agrees to indemnify and hold harmless the Church and its affiliates from any liability if the Individual causes injury or property damage to others during the trip/event β whether partially or fully at fault.
3. Assumption of Risk
Individual understands that if injured or if property is damaged during the trip/event, the Church and its personnel are not liable, even if partially or wholly at fault. The Individual assumes all risks involved.
4. Private Vehicle Responsibility
If the Individual drives or provides transportation, they accept full responsibility for the vehicle and passengers. If riding in a private vehicle, the Church and its personnel assume no responsibility for the safety of such transportation.
5. Medical Authorization
Individual affirms they have disclosed any existing medical conditions or medications. In the event of injury, they authorize trip leaders or qualified individuals to administer first aid or obtain emergency medical treatment. The Church is not obligated to provide medical care and is not liable for any failure to do so.
6. Dispute Resolution β Christian Mediation & Arbitration
The parties agree to resolve all disputes through biblically based mediation in accordance with Matthew 5:23β24, Matthew 18:15β20, and 1 Corinthians 6:1β8.
- If mediation fails, disputes will be resolved through binding arbitration using the Rules of Procedure for Christian Conciliation by Peacemaker Ministries (Billings, MT | 406-256-1583).
- The decision of the arbitrator will be final and legally binding.
- This is the exclusive remedy for resolving disputes; both parties waive their right to file a lawsuit, except to enforce the arbitration ruling.
7. Acknowledgment
By signing below, you acknowledge that:
- You have had the opportunity to review this waiver.
- You understand and accept its terms.
- You are signing on behalf of yourself and all minor individuals in your household, if applicable.
